These Terms and Conditions ("Terms") govern your use of purescalegrowth.com (the "Site"), our SMS and chatbot programs, and any services provided by Pure Scale Growth Partners ("Pure Scale Growth Partners," "we," "us," or "our"). By accessing the Site, opting in to our messaging programs, or using our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use our services. By using the Site or our services, you represent that you meet these requirements.
2. Description of Services
Pure Scale Growth Partners provides AI-powered marketing automation and growth services to local service businesses, including voice AI receptionist services, automated lead follow-up workflows, appointment booking automation, review generation, and related marketing visibility services. Specific deliverables, pricing, and timelines are described in the applicable service agreement, proposal, or order form between you and Pure Scale Growth Partners.
3. SMS and Chatbot Program Terms
The following terms apply to our SMS messaging program and chatbot communications. By providing your phone number and opting in (through the chatbot widget, a web form, verbally on a call, or by texting us), you agree to these terms.
a. Program Name and Description
Program Name: Pure Scale Growth Partners
Pure Scale Growth Partners operates an SMS program that sends messages in response to your inquiries, schedules and confirms appointments, sends appointment reminders and follow-ups, requests reviews after appointments, sends service-related updates, and re-engages prior contacts who have previously expressed interest. Some messages may be sent by an automated assistant on our behalf.
b. Opt-Out Instructions
You can cancel the SMS service at any time. Simply text STOP to the number you are receiving messages from. After you send STOP, we will send you an SMS message confirming that you have unsubscribed. After that confirmation, you will no longer receive SMS messages from us.
c. Rejoining Instructions
If you change your mind and want to receive SMS messages again, you can rejoin by signing up the same way you did initially — through our website chatbot widget, a web form, or by contacting us directly — and we will resume sending SMS messages to you.
d. Help Instructions
If you experience issues with the messaging program, reply HELP for assistance, or contact us directly at [email protected] or +1 (760) 798-5420.
e. Carrier Liability
Carriers are not liable for delayed or undelivered messages.
f. Message and Data Rates
Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
g. Privacy Policy

h. Compliance with Industry Standards
Our SMS program is operated in compliance with applicable carrier compliance requirements, industry standards (including those published by the CTIA), and applicable law.
i. Legal Compliance
By participating in our SMS program, you confirm that the phone number you provided belongs to you, that you are authorized to consent to receive messages at that number, and that your participation complies with all applicable laws and regulations.
4. Payment Terms
Services are billed at the rates and on the schedule set out in your service agreement or order form. Unless otherwise agreed in writing, fees are billed monthly in advance, are non-refundable except as expressly stated, and are due on the invoice date. Late payments may result in suspension of services.
5. Client Responsibilities
To enable us to deliver services effectively, you agree to:
Provide accurate and complete information during onboarding and throughout the engagement. Respond in a reasonable timeframe to requests for information, approvals, or access required to deliver services. Maintain ownership of and provide us with the necessary permissions to access any accounts, platforms, or systems we are asked to operate on your behalf.
Comply with all applicable laws and regulations, including communications, advertising, and consumer protection laws, in your use of our services.
Not use our services or AI tools to send unsolicited messages, prohibited content, or content that violates carrier policies or applicable law.
6. Intellectual Property
All content on the Site — including text, graphics, logos, software, and the underlying technology — is owned by Pure Scale Growth Partners or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site or our services without our prior written consent. Any content you provide to us in the course of receiving our services remains your property. You grant us a limited license to use that content solely to deliver the services you have requested.
7. Acceptable Use
You agree not to use the Site or our services to:
Violate any applicable law or regulation. Send spam, phishing, smishing, or any deceptive or fraudulent communications.
Send content that is unlawful, harmful, threatening, harassing, defamatory, obscene, or otherwise objectionable.
Send messages containing prohibited content under carrier rules, including content related to illegal activity, age-restricted topics without appropriate gating, or social engineering. Interfere with or disrupt the Site, our services, or any networks or systems used to provide them.
Attempt to gain unauthorized access to any part of the Site, our services, or any related systems.
8. Disclaimers
The Site and our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pure Scale Growth Partners disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific outcome, lead volume, conversion rate, or business result from the use of our services. Marketing and AI-driven results vary based on many factors outside our control.
9. Limitation of Liability
To the fullest extent permitted by law, Pure Scale Growth Partners and its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or the services shall not exceed the amount you paid to us for the services in the three (3) months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Pure Scale Growth Partners and its owners, employees, contractors, and affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site or services, your violation of any law or the rights of any party, or any content you provide to us.
11. Termination
Either party may terminate the service agreement in accordance with its terms. We may suspend or terminate your access to the Site or services immediately if you breach these Terms, fail to make a required payment, or use the services in a way that creates legal or compliance risk for us or our providers. Upon termination, your right to use the Site and our services ends. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or our services shall be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. If we make material changes, we will provide notice through the Site or by other means as appropriate. Your continued use of the Site or services after the changes take effect constitutes acceptance of the updated Terms.
14. Entire Agreement
These Terms, together with the Privacy Policy and any service agreement or order form between you and Pure Scale Growth Partners, constitute the entire agreement between you and Pure Scale Growth Partners regarding the Site and our services and supersede all prior agreements and understandings on the subject.
